Advising a major Syndicate in bankruptcy proceedings against KBBO group
Horizons & Co. is delighted to announce their achievement on the prestigious case regarding the long-running AED 1.2+ billion litigation by obtaining a Dubai Cassation Court decision. We represent the parties to a joint venture who were the contractors in relation to this complex dispute brought by the insurance company which relates to a fire at a prestigious Dubai hotel.
The Court confirmed that our clients, the parties to a joint venture which constructed the hotel, were not responsible for the incident in case brought by the insurance company.
This confirms a ruling in favour of the defendants which was upheld by the Dubai Court of Appeal on 13 September 2022 and ends this complex and drawn-out case.
The damages of AED 1.2+ billion were initially borne by the developer and later recovered from the insurance company as part of a settlement for the accident. However, the insurance company then filed a civil lawsuit at Dubai Courts to recover the amount, claiming the contractors failed to implement fire safety requirements.
Our team played an important role in the successful resolution of the case by drawing out a key point found a panel of experts that it had been proven that the claimant (the insurance company) was reinstated to its original position by the re-insurance companies. The complex nature of the experts’ reports and the overall process are testament to how technically saturated this dispute was.
