We represented Heriot Watt University Dubai in a case filed against our client by Study World Higher Education Services FZ LLC in relation to early termination of an agreement, claiming damages and part of the share revenue as well.
We defended the client in the case filed, and then filed a counterclaim for the value of AED 39 million. We handled the matters to review the University and Study World’s records and agreements from the past 15 years.
After a long litigation and cross-border dispute in the UAE and Scottish Courts, we convinced the Court of First Instance, the appointed experts and the Court of Appeal on the rights of Heriot Watt, and that accusations raised by Study World were false. We were successful in convincing the Court that our client is entitled to the full claimed amount + 5% legal interest.
Adv. Ali Al Zarooni provided the Scottish Court an affidavit on the claim before the UAE Court and the procedures and the implementation of the UAE laws, as well as the enforceability of the Scottish Court’s judgment before the UAE court in relation to the related dispute.
